In order to reach a final decision in civil litigation, a number of procedural processes must be completed. Civil litigation are usually about monetary transactions or property disputes, and they are about claiming damages or compensation for losses. A civil litigation is one in which one or more people are accused of breaking the law. When one person wrongs another, civil litigation ensues. Both individuals are referred to as the parties or litigants in this context. Civil litigation is concerned with the resolution of non-criminal conflicts. The Code of Civil Procedure, 1908 governs civil litigation. When the court accepts the plaint, a summons is issued to the defendant against whom the complaint is filed. The defendant must appear in court in person or be represented by a legal counsel. The term "summon" is not defined in the 1908 Code of Civil Procedure, rather it is essentially a writ stating that legal action is being taken against the defendant.
